Trade Union Information – New Employer Duty Delayed to January 2027

I wanted to provide a brief update regarding the impending new requirement for employers to inform workers of their right to join a trade union.
The Government had previously indicated that this new duty would be introduced as part of the employment law changes taking effect from October 2026. It has now confirmed that the requirement will instead come into force on 1 January 2027.
What will employers need to do?
From 1 January 2027, employers will be required to provide workers with a standardised written statement informing them of their right to join a trade union.
For new workers, the statement will need to be provided at the same time as their written statement of employment particulars.
Employers will also need to make the statement available to existing workers. The Government has confirmed that existing workers will need to receive the information, or be informed where it is available, by 5 April 2027. There will then be an ongoing annual requirement.
Can employers prepare their own wording?
No.
Importantly, the Government has confirmed that it will prescribe a standardised statement for employers to use. Employers will not therefore need to draft their own statement explaining trade union rights.
The statement is expected to include information about the right to join a trade union, the functions of trade unions, relevant statutory rights and, where applicable, details of any recognised trade unions or statutory access arrangements.
The Government is expected to publish further detailed guidance in November 2026.
There is therefore no immediate action required. We will monitor the position and will circulate the Government's prescribed wording, together with guidance on how and when it should be issued, as soon as it becomes available.
