Trade Union Right of Access (from 30th October 2026)
Alan Kitto
From 30 October 2026, independent trade unions will have a new legal right to ask employers for access to their workforce, under the Employment Rights Act 2025.
A union can make an access request whether or not it is recognised, and even if it has no members in your business. Access can be in person, such as visiting your premises, or digital, such as communicating with staff through your systems. If you and the union can't agree terms, the Central Arbitration Committee (CAC) can decide for you, and it can impose financial penalties if an agreement or decision isn't followed.
The timescales for responding are short. If a request is ignored, the union can go straight to the CAC, and you lose the chance to shape the terms. Even if you don't expect a request, it's worth deciding now who will handle one and what access you could reasonably offer.
Our info-sheet explains how the process works, what access can and can't be used for, and the practical steps to take. It's attached to this email. You can download the info-sheet here.
If you receive an access request, or would like help getting ready, please get in touch. We're happy to help.
